Co-lead counsel for Allergan in connection with government investigations and civil litigation involving prescription opioids, including multidistrict litigation (MDL) before the Northern District of Ohio. Donna serves on the MDL court’s steering and settlement committees and is trial counsel in civil litigation pending in multiple state courts around the country, involving claims for public nuisance, fraud and civil conspiracy.
Lead counsel for First American Financial Corporation in case challenging its involvement in a Marriott time share program, alleging violations of the Florida Condominium and Timeshare Acts and Florida’s RICO statute. Secured summary judgment on all claims, and argued the appeal in the Eleventh Circuit resulting in affirmance of the dismissal on all claims.
Co-lead counsel for portfolio of Army military housing projects in litigation in multiple state courts against bond insurer claims that projects must pay more than $200 million for breach of loan agreements. Negotiated highly favorable settlement after winning three preliminary injunctions and obtaining summary judgment in multiple actions.
Obtained historic settlement of nearly $200 million on behalf of four military housing projects. The settlement resolved claims of fraud, breach of fiduciary duty and civil RICO against a third-party property management firm, and its chairman and CEO.
Successful prosecution of multibillion-dollar claims of breach of fiduciary duty, conspiracy and breach of contract. Obtained summary judgment finding that three of the largest real estate investment trusts (REITs) had breached their fiduciary duties to limited partners in connection with usurpation of more than $2.5 billion in corporate opportunities.
Successful prosecution of breach of fiduciary duty, fraud and conspiracy claims arising out of scheme involving corporate fraud and kickbacks in violation of the Wisconsin Organized Crime Control Act. Obtained the largest civil verdict recorded in Wisconsin and a Top Ten National Jury Verdict, after a four-week jury trial.
