Bankruptcy Representative Matters

• Represented Windstream Holdings, Inc., and its debtor subsidiaries in their Chapter 11 restructuring in the U.S. Bankruptcy Court for the Southern District of New York. Windstream confirmed a Chapter 11 plan of reorganization that addresses more than $5.6 billion in funded debt obligations.
• Represented Blackhawk Mining LLC and its affiliates in their prepackaged Chapter 11 cases in the United States Bankruptcy Court for the District of Delaware. Blackhawk is a leading metallurgical coal producer based in Lexington, Kentucky. Blackhawk entered Chapter 11 to implement a prepackaged plan of reorganization that will eliminate approximately $650 million of the Company’s nearly $1.1 billion in prepetition funded debt.

Liability Management Representative Matters

• Represented TriMark USA, a distributor of foodservice equipment and supplies to restaurants, in connection with its recapitalization executed with a group of majority first lien term lenders.
• Represented Boardriders, a surfing and skateboarding apparel company, in connection with its recapitalization executed with a group of majority first lien term lenders.
• Represented Pretium Packaging, a designer and manufacturer of rigid packaging solutions, in a comprehensive transaction that includes new debt financing and an exchange of existing debt with first lien lenders.
